On 15 September 2017, the Parliament of Fiji passed the International Arbitration Bill 2017 as an Act of Parliament and was assented to by His Excellency, the President of the Republic of Fiji on 18 September 2017. The International Arbitration Act (Act No. 44 of 2017) incorporated provisions based on the UNCITRAL Model Law on International Commercial Arbitration (1985) (with amendments as adopted in 2006)(“Model Law”), in Fijian law. This legal reform resulted from a technical assistance project in the context of a joint collaboration between the Asian Development Bank and the UNCITRAL Regional Centre for Asia and the Pacific, aimed at reforming the dispute settlement legal regimes in the Pacific Small Island Developing States. The Arbitration Act has been recognised by the UNCITRAL Secretariat as an enactment of the Model Law. Fiji becomes the 76th State worldwide and the 24th out of 56 States in the Asia Pacific region to adopt the Model Law. More information regarding status of implementation may be found here:
